The SFA Judicial Panel Disciplinary Tribunal sit for the first time today to examine Rangers Uefa licence application in 2011, the subject of which was picked up by the ‘Res 12’ group of Celtic shareholders. This application was made under Craig Whyte’s memorable tenure which saw the club withhold tax payments before the eventual appointment of liquidators.
Evidence of what took place was eventually heard in open court, at Whyte’s trial in Glasgow last year. Rangers did not declare to the SFA they failed to make tax payments and should not have been granted a Uefa licence. As a consequence, Celtic, who finished second in the league that year, were denied a chance to participate in the Champions League qualifiers.
So far, so clear, but then the matter becomes subject to issues not heard in court, specifically the Five Way Agreement between the SFA, the (now defunct) Scottish Football League, the Scottish Premier League (now the Scottish Professional Football League), oldco Rangers (now also defunct) and Sevco Scotland (now newco Rangers).
This Agreement gave Sevco Scotland associate membership of the SFA and a place in the Scottish Football League in return for accepting some, though not all, of Rangers football penalties. Newco When the SFA announced this Tribunal, Newco did not contest the guilt of Oldco, instead suggesting they had agreement of immunity on this matter. The SFA clearly believe differently.
The Judicial Panel will first decide on its competency to hear the matter, based on whatever partial immunity Charles Green secured for Newco in 2012. If the terms of the immunity is not sufficient to exempt the worst excesses of Craig Whyte, the panel’s punishment of Oldco will apply to Newco.
The extent of this one is significant, effectively cheating to gain entry to the Champions League. I expect nothing less than a multi-year ban from European competition.

Craig Whyte appointed administrators who would release the name ‘Rangers’ and associated intellectual property to Newco, unlike administrators at Airdrieonians in 2002, who refused the then Clydebank to rename themselves Airdrieonians. The name was subsequently changed to Airdrieonians in 2013.
Whyte’s plan was to buy the brand name from Rangers administrators and put the Scottish football authorities on the spot. In buying the assets from the administrators, Green had control of the name by the time of the Five Way Agreement, and he accepted some liabilities as a price for entry on the nod into Scottish football.
This resulted in a debate that will never end. Newco claim continuity with Oldco when selling tickets, but not so much at times like this. No ‘Say No to liquidation’ banners were noted in the asset register.
Green claimed Sevco Scotland “bought the history” from administrators Duff and Phelps (you will not be surprised to learn ‘the history’ was not on the asset list purchased). Now lawyers for Green’s one-time rival for Oldco’s assets will try to fortify his work.
We’ll see if Dave King’s recent sabre-rattling has been effective.

Sad to see Armstrong go. McGinn seems to be at a similar(ish) level to Armstrong when he joined. Initially it is a little step backwards but I’m sure BR thinks there is sufficient scope for improvement. Also, we have Ntcham who will be first choice for that position.
The right back looks like an interesting “project”. I guess it could go Craig Gordon or Carlton Cole!!

I haven’t been on recently but felt that I needed to give my tuppence worth re Armstrong. I’m not disappointed he has gone and don’t wish him any ill feeling, however, I hope he enjoys his medals he won with the Hoops because I doubt he will win any more.
Celtic I feel should have sold him last season when he wouldn’t commit but he’s gone now and we move on. Not sure McGinn is the answer and I hope the likes of Christie, Allan and Morgan give the boss something to think about,
Delighted for Argentina last night as would love to see Messi rewarded with a world cup medal, best in the world in my humble opinion.

Yes I do actually. We were 4-1 down at one stage but stuck to the task and scored 2 more goals. I also remember we had Nir Bitton in central defence as well as a very raw Kris Ajer who stuck out his leg and scored an own goal. We also had a lot of injuries. So what exactly is your point? We won the tie by FOUR goals. It cannot compare to Beer Sheva.

The Referees this tournament, IMO, have been very poor – without taking VAR in to consideration.
The Rules are there to be administered. So many Definite Yellows have not been dished out.
If they don’t want players missing games then change the punishments to better suit…….. WhoEvaaaah.
Whoever is overseeing the Refereeing, giving guidance, is just taking the p!ss.
Having said All of that, Celtic when not on TV would do well to have a Referee this good @ the Festival of Football. o_0 ….. At least the foul will be acknowledged.

Jim Baxter got a broken leg in a euro game – show-boating once to often. I dont think he was quite the same player after.
*I recall that day well, it had been an afternoon ko and deidco were over in Vienna with a slender 1-0 lead from the 1st leg.
I was on the train home when a punter got on at Dumbarton Central, he had one of the evening papers with him and just as the train crossed the bridge of the River Leven he enlightened us all with the news they had won 2-0 over there, a very credible results, a lot of heids went down until he read the stop press, baxter had broken his leg, a huge roar went up, it was the only solace us young Tims could find and a pre-Christmas present tae.
As you say in the last minute he tried tae extract the urine, the offending player wisnae even cautioned as far as I can recall.
It seems he hit the bottle hard after that allegedly drinking 3 bottles of laurel and hardy a day although that seems highly unlikely.

There seems to be a number of people who do not hold out much hope re outcome of the R12 inquiry.
Can’t say I know enough about it tbh but it would be nice to see some honesty from those involved for a change. We deserve better to coin a phrase.
