The premier business paper where Uefa is headquartered in Nyon, Tribune de Geneve, today ran an advert, paid for by public subscription, questioning the governance of Scottish football.

The advert asked readers to reference The Offshore Game report: Doing SFA for Fair Play and explained some of the issues governance, accountability and oversight in Scottish football.  It reads:

“A report by The Offshore Game (TOG), an arm of The Tax Justice Network (TJN), has highlighted examples of poor SFA governance in respect of:

• A Commission established in 2012 by the Scottish Premier League to investigate the use of employee benefit trusts to reduce the tax paid to HMRC by an SFA member club where the SFA provided key testimony which is now being questioned.

• The processing of a UEFA Licence in 2011 by The SFA when Court Officers called to collect overdue tax from a member club between Champions League and Europa League qualifying games. Proving there were no overdue and unpaid taxes was a condition of granting then retaining a licence to compete in both UEFA competitions. The tax concerned was never paid!

• The SFA have neither commented on the TJN report nor attempted to address the issues it raises. The TJN has called for an independent review of the SFA to make it more accountable.

• A group of shareholders of Celtic PLC acting in terms of Resolution 12 of the Celtic PLC AGM of 2013, have been pressing the SFA for over two years for a satisfactory explanation of their administration of the UEFA licensing process in 2011. In the absence of any meaningful reply they have now taken up the case with the UEFA Club Financial Control Body.

The TOG report highlights the financial cost over a decade to the British Taxpayer in Millions of pounds. The cost to Scottish football in terms of the loss of trust placed in the SFA to govern the Scottish game with integrity is incalculable.

Football fans everywhere are invited to read this important report into the game in Scotland.”

Our game suffers from a perceived lack of oversight, accountability and governance; fundamental requirements in modern sport which have been painfully lacking across world football for decades.  Uefa now have an opportunity to measure where Scottish football, and their own processes, are on these metrics.

    So how many contributed believing the sponsored spin from CQN about the Plc now being on board with the resolution 12 message and how many would not have contributed if they realised it was just yet another Plc. ruse to boost ST sales ?

    My information on Res 12 has come mostly from BRTH than anyone else. If you look at the STV story and what Regan is saying, well guess who from this blog actually went to the SFA to discuss and get them to move their position. I’ll give you a clue – it wasn’t you.

     

     

    How much did the PLC hand over for free books? It was nothing to do with them. The biggest net contributor to the fund was CQN Books from the £5 donations. Celticrollercoaster is auditing and will report back in due course.

    STV fail to make the distinction between the EBT scheme and the DOS.

     

     

     

    Rangers were awarded a UEFA Club Licence despite having an outstanding £2.8m payment to HMRC over their use of Employee Benefit Trusts, in what is commonly referred to as the “wee tax case”.

     

     

    The outstanding £2.8m payment had nothing to do with EBT’s but everything to do with the illeagal Discounted Option Scheme (DOS).

    So, Regan says the SFA went by the book up until the 31st March UEFA Licencing deadline. (There’s an interesting aside here: That year Rangers plc published its Interim Report on the 1 April, failing to make the AIM regulation deadline. In it, they declared the HMRC liability re the WTC.)

     

     

    Regan also says that the Licence checkpoints at 30th June and 30th September are UEFA’s remit.

     

     

    In effect, Regan is saying: We did our bit by the book. The Res 12 guys are satisfied that we did our bit by the book. If there are anomalies in the Licencing process subsequent to that, it’s a matter for UEFA to consider, and we have directed enquiries to them.

     

     

    UEFA are keeping Schtum.

     

     

    Celtic are keeping Schtum.

     

     

    Someone’s going to have to do something formal to move it on. One assumes that someone is Celtic, acting on behalf of, and at the instigation of, the shareholders who brought the resolution.

     

     

    IF Celtic now move.

     

     

    And IF irregularities are identified.

     

     

    Then there is a serious matter to consider.

     

     

    It’s one thing misleading the SFA. For some folk, it’s the default position.

     

     

    It’s quite another misleading UEFA to the extent that a Licence was awarded in circumstances in which, in ordinary course, it would not have been.

     

     

    We have an IF-squared type scenario, where it is improbable that both conditions will be satisfied, but were they to be, the consequences would be significant.

    Oddly enough, the illeagal Discounted Option Scheme (DOS) was also omitted from the Lord Nimmo Smith (LNS) inquiry.

    They don’t have the full support of our PLC.

     

     

    They are a blunt instrument trying to make an incision into the stomach of a giant whale.

     

     

    Without the brute force of the weight of the PLC behind them , this is going nowhere.

     

     

    The SFA and UEFA will just ignore the adverts and carry on as normal.

     

     

    The resolutioners are giving their all.

    Nothing new in Regan’s statement.

     

     

    On a point of detail RFC announced a potential liability on 1st April when it was an actual liability at that point which is where the fudging began. It wasn’t an overdue payable as UEFA define it at that point but RFC had admitted liability before end March.

     

     

    With regard to 30 June it has always been SFA’s position that after granting, monitoring is for UEFA.

     

     

    This is something that needs clarified as it would seem it can lead to a position that a club can have Sherrif Officers call to collect overdue tax between a CL qualifying round and an EL qualifying round, suggesting rules not fit for purpose or somebody got the interpretation wrong. Either way UEFA surely must now offer clarification?

     

     

    There is another aspect that has almost been overlooked and that is the significant event of the Takeover on 6th May. Given it transpires CW didn’t have a pot to piss in and the licence was granted on the basis that RFC were a going concern under SDM, what steps did SFA take to satisfy UEFA that the licence they had granted on 31st March to RFC under SDM was on as solid ground under CW? What kind of diligence would UEFA expect in that kind of case.

     

     

    It is issues such as this that UEFA should be looking at so it looks like Res12 is heading in the right direction to get answers and seeking accountability.

     

     

    I notice no questions to him on the TOG/ LNS issue but interesting SFA have stuck their head above the parapet.

    The ambiguity between whose job it was to monitor the licence will be the Get Out of Jail Free card.

     

     

    UEFA will admit that their rule left a margin of doubt as to whose responsibility it was, give themselves a wee smack oh the wrist, exonerate the SFA and then move on.
