A stream of criticism appeared in yesterday’s comments section to greet media coverage of yesterday’s Scottish Cup draw away to Inverness Caledonian Thistle or Dunfermline on 4 February.  Such is our lot (long) after shock cup defeats; remember, these guys literally have to write something.  No one mentioned 1961 so put your money on a trip to Fife next month.

A few moments ago Celtic confirmed Beram Kayal went through his operation yesterday and is now targeting a return to action for preseason.  Irrespective of the circumstances of the incident in which he was injured, Beram’s is another in a long list of soft tissue injuries Celtic players have suffered in recent seasons, a fact which should engage minds at the club.

Rangers issued a really curious statement following the suspension of trading in their shares by the Plus Stock Exchange.  Many Rangers fans have invested thousands of pounds in club shares and bonds, so one would have expected to read the obligatory suggestion from the company that investors take professional advice when addressing the withdrawal of the share disposal service.  Still, at least they didn’t suggest “Rangers Football Club PLC could survive any administration event but feels it would not be the end of the world if it didn’t”.  That kind of comment from those charged to look after their interests really would alarm shareholders.

    I’ve not focussed on that aspect. My feeling is that the dirty washing will only be hung out to dry if somebody does not get their way in terms of how this pans out.

     

     

    The parallel is the “dossier”. I am not saying at all that one exists but the unanswered questions will demand an answer as the game comes to grips with what it is facing. Number one being how did Rangers get away with it?

     

     

    By the by I saw a guy on RTC asking if anyone knew what steps the SFA took to check up on and confirm with HMRC if they thought there was tax outsanding last 31 March – the wee bill. Says he has written to Broadfoot but had no answer so far. If Rangers were taken at their word that all was hunky dory then clearly the SFA have to look at their processes and strengthen them.Makingthese as water tight as possible is essential.

     

     

    I have observed a peculiar behaviour by Rangers in terms of scrupulous use of the rules whenever it suits their case. The McCulloch appeal for example, the rules allowed it and that makes it OK, absolutely no attempt at working to the spirit of the rules. All the decisions they got pre change to the RP process where only once did a ref not bow to pressure to change his mind, their incredulity when Aluko and Naismith got done under the new rules. The delay in a hearing on Bougherra and Diouf under the old rules that enabled pressure to be put on the referee. Even the defense of the EBTs is based on “if the rules allow it then its ok”, no question of moral wrong doing.

     

     

    The idea of having to have to play against an uncorrected and incorrigible Rangers in future years appals me as it should every right minded person.

  5. Been away for a few days and speed reading back. Was a bit miffed at first to read ghuys getting email confirmation that CQN.5 was being posted out tomorrow – until it dawned on me that it was ordered on Mrs TITO’s paypal and the email was sent to her (dooh!)

     

     

    The air is now being pumped into the balloon down govan way. Last year I wanted a big bang, but the pace this is moving at is better. Death by 1000 cuts, and too many really clever ghuys on here and RTC etc. to let any illegal shenanigans go un-noticed. Life is good. The re-calibration of the meedja has started, but it will take a long time. (Who came up with the saying “Ye can teach a monkey new tricks?”)

    OK let’s look at this pragmatically.

     

     

    By now we all know what rule 14 says– and I think none of is can see how that rule makes admission of a team to the league a matter for the board– other than that board acting on the instruction of the company in general meeting having passed a qualified resolution.

     

     

    However, let’s presume that we are the board of Celtic PLC, aand we are told by one of our fellow league clubs that they have an opinion which says that contrary to our view of rule 14, the admission of a club is a matter for the board and their discretion, and not a matter for the company in general.

     

     

    The first thing I would do would be to ask for a copy of the opinion concerned. I would want to see what it says and I would want to see who it is from.

     

     

    Make no mistake, the quality of any legal opinion can vary greatly depending upon who the opinion is for, who has written it and whether or not the matters under opinion are within the area of expertise of the writer of the opinion.

     

     

    In my time I have seen opinions which were complete balderdash and not worth the paper they were written on.

     

     

    In some cases opinions are lengthy and detailed. The shortest simply said ” You are correct!”

     

     

    I don’t see how anyone can takle the view that any of this is a matter for the board.

     

     

    When discussing the reorganisation of the league, was it the SPL Board that met at Hampden or was it the representatives of all the league clubs?

     

     

    The board of directors of any company are there to implement the wishes of the company in general meeting. They are answerable to the shareholders.

     

     

    Now the company Lawyers represent the company as a whole. Those who say that it is for the board to decide should be challenged on that view. The safe thing to do is to have any decision determined by the Company in general meeting– notwithstanding the terms of the srticles of association.

     

     

    However, one key thing is that the lawyers would not want to be seen to give the wrong advice which if followed could then leave the company open to litigation. The lawyers will protect their back, and protecting their back means having all decisions being approved by the company– articles or no articles!

    I share your anger with these guys, but it’s more enjoyable to hear the pain that they are in

     

    as they now realise how emtpy their WATP mantra has become.

     

     

    The tables have turned, they are skint members and all their supremacy based comfort messages are now empty sounds.

     

     

    There were no tears or concerns when we were in a bad way, only gloating, so it’s pay back time and we should fill our boots!

     

     

    Looking forward to sitting back and enjoying the carnage to come.

    Not sure what you mean by “targetting” Ernie. If by that you mean representatives of supporters groups deciding what they would accept and then talking to Celtic to find out their position then I agree with that.

     

     

    If you are suggesting that the support’s default position is that the Board are not to be trusted and we approach them in that frame of mind then the chances of weilding influence are zilch and we would be fighting the wrong target.

     

     

    At the time of the honest mistakes the supporters articulated what we wanted to happen and went to Celtic with it and the threat of boycott. They wanted the same thing and both sides worked together from that point to get SFA reform.

     

     

    If it turns out there is a difference of views then that becomes something to target.

     

     

    However I have read Barcabhoy state that from personal contact the Celtic Board are against Newco in the SPL on integrity grounds for the very reason that Celtic have acted with integrity over the past 4 years at great cost to the club and the Board members themselves. Why they would change this position now that the destination is in sight does not make sense.

     

     

    What they will be helped by in arguing their case with the SPL is a clear independent statement from the supporter groups about what is unacceptable and what is.

     

     

    If that means a threat it has to be credible and will be all the stronger if other clubs supporters back the demand. I would prefer the term supporters strike rather than boycott.

    If only they’d had a look in to CQN over the last 18 months then this wouldn’t have come as such an obvious surprise.

    What concerns me is that Paul has said that a member club, let’s for the sake of argument call them Celtic, had been of the opinion we all share regarding the need for a 90% vote of members, but received legal advice, which I assume would be from senior counsel, to the contrary.

     

     

    Now either there’s an angle to this which we’re all missing, or someone is playing silly buggers.

     

     

    The worry is that the Celtic board want a newco huns admitted to the SPL but don’t wish to be seen to be party to any such decision. If that’s the case an opinion, however equivocal, that it’s a matter for the SPL board alone to decide would square that particular circle. ‘Our hands were tied. We could do no other’.

  14. The articles and rules of the SFA and SPL have been thoroughly analysed to determine whether or not RFC2012 can regain admittance to the SPL and at what level.

     

    However, if RFC2012 rises from the gates of hell, to assume the mantle and colours of Rangers 1873, what is the legal perception from Her Majesty’s Revenue Collectors?

     

    They will be de facto the same team, claiming the same past history, using the same assets, in the same location with the same clientele.

     

    Will HMRC be able to refuse the formation and registration of them as a company as bthey have blatantly reneged on their fiscal res[onsibilities to pay their due taxes and conform to legitimate business practises?

     

    If they are refused a licence to trade any discussions re their re entry to the SPL will surely be moot.

    I suppose a lot of this is a waiting game, untill knowns are know we really don’t know what front needs fighting on.

     

     

    As for their lack of dignty re the fast track system, never expected anything else.

     

     

    The dossier exists, it’s been alluded to by Dr John, Paul and I know someone who has said he has seen it, or extracts from it, and he inferred doctored referee reports.

     

     

    I seem to recall DR John saying something about bringing scottish football to it’s knees, I stand to be corrected on that, at least it’s no up to the knees then :>)

     

     

    I agree that the process at the sfa needs to be looked at and tightened up, but that don’t help us for their past misdeeds.

     

     

    I still think also that a group of small shareholders should get together and consult a lawyer re the issuing of euro licences to them, it would be well worth the money spent imo.

    I’m not having a go at the Board.

     

     

    It’s easy enough for us but we’re not the ones who owe the fiduciary duties they do as directors.

     

     

    I would almost go so far as to say that if the Celtic board were going to oppose the admission of the newco huns they’d be calling an EGM to get the backing of the shareholders.

    Like you I only listen in when I am in the car and it’s on air and thankfully thats not a lot.

     

     

    They were probably looking into CQN but I suspect none of them had the inclination to dig deeper

     

    as the media have in the past and still mainly are sympathetic to them.

     

     

    The only guy that had a go at them in recent times is Spiers and even he had wind his neck in.

     

     

    Thanks to CQN and people like Phil and RTC the truth has been out there for a while allowing us to get a whiff of what is going on

     

    while the ostriches did what they do best.

    I for one would consider myself a fool to pay good money to watch competition against a club who are much more untrustworthy than the Celtic Board. A club for whom the concept of wrongdoing is totally alien.

     

     

    It might only be a strike by one but I’ll not pay a penny to be defrauded.

    The money argument doesn’t stack up. A clear run at whatever Champions’ League cash benighted Scotland is entitled to surely more than makes up for the loss, even if we don’t qualify every season. Champions’ League qualifiers, group stages some seasons, Europa League other seasons, practically guaranteed first prize in the SPL surely makes up for the loss of two league games against Rangers and a worse TV deal.

     

     

    Those games will be paid, albeit against a much smaller rival. The TV deal is not worth preserving. If there is a Newco, we stand as much chance of drawing them in cup games as we have of drawing Rangers now.

    If Rankers go into administration, does the administrator not have a duty to get as much for the assets as possible ?

     

    So , theoretically, if a supermarket chain fancied a new store in the south side of Glagow, and was looking for land, and was the highest bidder , is the administrator not required to consider all options ?

    it is one of their famous fantasies just like no extension was ever given to them. The real issue was that had the season been extended until fair Friday which was what they wanted SPL teams would have lost players to Euro 2008

     

     

    Celtic had Boruc, JVOH, Samaras all going

     

     

    Rangers had no one of course

     

     

    INverness had thon Rumanian Striker who played up front with the guy who was at Chelsea at one point.

    I recall they managed to get the SFA to look seriously at pushing back the Cup Final as well. G Smith was well up for that as I recall,

     

    even though it was clearly unfair on the other finalist.

    Don’t put beer in the freezer and forget about it. The frozen vegetables will need to go in a beef and ale pie or something similar now.
