Strict Liability, for you, but not for me

The Scottish Government yesterday suggested the SFA act unilaterally to introduce Strict Liability on the game, making clubs liable for the actions of their lunatic fringe, or else the government would impose measures. This is a curious stance for a government who are not prepared to accept ANY liability for their own lunatic fringe.

When the lunatics in charge only see other people’s lunatics, we’re all in trouble. And it should be noted, lunatics inhibiting a democracy cause vastly more damage than football fans fighting on a field once every 36 years.

The notion of Strict Liability in itself is a separate question, but I have serious concerns at the increasingly right wing, and selective, attitude to law and control at Holyrood.

If you want to impose Strict Liability on football, accept if for yourself first. Then come back after a year’s experience and talk to us about football.  This, of course, will never happen.  Not all lunatic fringes are equal.

    Indeed, our own club were founded as a charitable response to a political issue.

    What was delivered literally was a culmination of 2-3 years work between the resolutioners and Celtic.

     

     

    What may or may not be delivered in terms of the end game in all of this is up to Uefa, but Celtic can’t be blamed if Uefa decide to deflect

  18. I’m trying to imagine what strict liability would look like for a Scottish Government?

     

     

    For a FC there are a range of sanctions applied if their ‘supporters’ break a range of pre-determined ‘rules’.

     

     

    What pre-determined rules would a Government have to breach in order to be chargeable?

     

     

    What would the review/court process look like to explore the charges?

     

     

    What would the sanctions be?

     

     

    Mr Pastry’s list may be policy weaknesses/embarrassments he disagrees with but it doesn’t amount to pre-set rules that a Government might have breached?

     

     

    Would it relate to the behaviour/conduct of all the citizenry/subjects (depending on your point of view) and that if said citizenry broke those rules the Government would be sanctioned?

     

     

    So for every conviction under the OB Act the Government might be sanctioned because said citizen had broken the rules and so all society is ‘punished’?

     

     

    If it was a ‘fine’ where would that go? A rebate to the offenders (all citizens) seems bonkers?

    Interesting reading about Strict Liability and how it could affect the Scottish Government. Does the OB act actually fall foul of article 6 of the European Convention on human rights. ?

     

    Although I’m not a legal eagle I would be confident that Ambiguity is absolutely no defence for the Scottish Government in what is a draconian monstrosity of a law.
