Justice without fear or favour, but much more to come

400

The SFA Judicial Panel which disciplined Rangers two weeks ago was independent of the SFA.  Tonight’s appellate panel was also independent but as I was reminded tonight, there’s independent and there’s ‘independent’.

Celtic Quick News has cast its share of aspersions in the direction of the SFA in recent years but even President What-school-did-you-go-to? could not spike what appears to be well established processes.

The consequences from tonight’s decision by the SFA appellant panel will run deep for Stewart Regan, and I suspect life would be easier for him if a more accommodating verdict was returned, but the structure he created delivered what he promised.  Justice, without fear or favour. Credit where due.

You and I have a responsibility to start rebuilding trust, and Scottish football, from here. Don’t wallow in past times, or a in an old victim mentality. Tomorrow belongs to you and your neighbours who support Aberdeen, Dundee United, Hibs, St Mirren, Motherwell and many others. Make sure you enjoy that future and are not consumed by past torments.

Rangers is a former football club.  They played their last game on Sunday 13 May 2012 at Perth.

We’ve been predicting this for months, and if you think the revelations and shocks are over, think again.  Empires will crumble, oceans will dry and galaxies will collide next week.  The surface has only been scratched.

  7. Apologies to the MSM.

When you reported CW as having off the radar wealth, we all stupidly thought you meant that he had billions just sitting there waiting to splash it all on RFCia.

We were of course completely wrong. What you obviously meant was that his wealth is either:

    a) Hidden so far away that no-one can see where it is (even using radar).

    b) Non-existent and therefore not registering on radar.

I suspect it is actually a bit of both. Yes, he has a) hidden his ill-gotten gains far enough away so that it is impossible to see where it is and b) the funding for RFCia’s ‘war chest’ is so small it doesn’t register even a tiny blip.

Apologies. Our mistake. Your description was spot on.

  8. From latest issue of Private Eye, if posted already please ignore:

    PLANET FOOTBALL Rangers

NEW Rangers saviour Charles Green is no stranger to football, and not just from his role back in the Nineties at Sheffield United.

Only in February he resigned for “personal reasons” and with immediate effect as non¬executive chairman of Formation Group, a post he had held since 2010, having been a director previously.

The listed property group lost almost £12m last year due to exceptional provisions on its developments. Formation had been profitable in 2010. But more interestingly, Formation also owns Proactive Sports Management, the company run by leading football agent Paul Stretford (Eyes passim). Formation sold and then bought back Proactive in 2010, resulting in Stretford and his partner, former Irish international Kevin Moran, owning 8 percent of the company.

Last year Proactive was largely successful in litigation with Wayne and Coleen Rooney over unpaid fees. Formation also settled a claim over unpaid transfer commissions with Gestifute, the agency run by Portuguese agent Jorge Mendes.

The remainder of the Green post-Sheffield corporate CV consists of small or dissolved companies. But no doubt through Stretford, Moran and others he can find investors with the deep pockets needed to resolve Rangers’ tax problems.

  10. Paul67,

Very Good article, it is indeed time to start believing we are being governed correctly after what has happened last night, and even then, no-one will ever be happy :) but the processes have now had the hardest possible roadtest and who knows Mr Regan may just have the best ever CV in a year or so. I sincerely hope he does have. Mr Fleming please take note and start dealing with the people who are threatening the game in Scotland with their pathetic attitudes.

  11. Just tuned into CQN and delighted to hear the news that the decision is being upheld. Like some of the other posters was lead to believe that the decision was going to be delayed once more. Seriously think the tide may be turning at very long last.

  17. From BBC Shortbreads news page this morning –

Entering administration meant Rangers were docked 10 points by the Scottish Premier League – a move that helped ensure that Rangers lost their title to Glasgow neighbours Celtic.

Nothing to do with Celtic overcoming a 15/17 points defecit and overhauling them well before they went in to recession

  18. Bon Dia ,! sun just rising here in Catalunya, yes, just me being an arse.

  19. Whacko Jacko’s Record Article below. The part in the middle about Jelavic pleading with Moyes to sign Naisy has not been Awe Nawed:

CHARLES GREEN’S Rangers takeover has been dealt a potentially devastating double whammy.

Last night the SFA refused to rescind a 12-month ban on buying new players – as Everton prepared to launch a cut-price swoop for Steven Naismith.

The crisis-ravaged Ibrox club was left reeling again when an appeal against a year-long transfer embargo – and a £160,000 fine – was booted into touch in a late-night hearing at Hampden.

The sanctions were handed out last month after a top-level probe into dealings by the shamed Craig Whyte regime but Rangers had hoped for some mercy to be shown yesterday.

Would-be new owner Green – whose plans to save the club from liquidation have been described by his own backers as being dependant on recruiting new players this summer – could even be forced to think twice about continuing with his proposed £8.5million rescue package.

Green insisted last night he will back a Duff and Phelps-led appeal against this latest decision.

Administrator Paul Clark said: “The club will consider seeking review of this most disappointing decision and it is a matter of regret that the certainty and finality Rangers sought on this matter has not been achieved.

“Everyone at Rangers is bitterly disappointed and dismayed at this outcome.”

Green added: “Our group went into the purchase of the club with this sanction in place but we hoped the

decision would at least be commuted. We fully support the club as it considers an appeal against this latest decision.”

The full scale of the crisis engulfing the club was highlighted when Record Sport learned talisman Naismith could be the first of seven star players to be lured away for a knockdown price. Former Rangers striker Nikica Jelavic has urged Everton boss Davie Moyes to land Naismith for a £2m snip.

Moyes has already held discussions with Jelavic and former Rangers skipper Davie Weir about launching a raid on Rangers for the Scotland man when the transfer window opens for business on June 1.

And Jelavic – who has been a smash hit in the Premier League since swapping Govan for Goodison in January – has pleaded with Moyes to reunite him with his former strike partner who, as we revealed yesterday, is one of seven star names in Ally McCoist’s first-team squad available on the cheap.

Jelavic’s opinion is highly valued by Moyes, the rest of the club’s coaching staff and the money men on Merseyside who are still preening themselves over the £5m capture of the Croat on the final day of the January sales.

And even though Naismith is still recovering from the second cruciate ligament injury of his career, Moyes believes that, at just £2m, it’s a gamble Everton can hardly afford not to take.

Moyes is also aware of the growing interest among rival bosses in the ongoing crisis situation at Rangers and may plead with his board to realise enough funds to enable him to move early for Naismith.

A conservative estimate of around £17m could be wiped off the value of McCoist’s squad unless Green can talk his star men into ripping up their rewritten deals .

After last night’s ruling, if he can’t it’s hard to see how Rangers will be able to

function as a competitive force at all next season.

Last night the SFA released a statement which said: “It was competent for Disciplinary Tribunal to impose the additional sanction of prohibiting registrations of any new players of 18 years or older for a period of 12 months.

“The Disciplinary Tribunal was correct in holding that the maximum fine available for this breach was £100,000, and on its own was inadequate as a punishment for this misconduct. It was therefore correct to select an additional sanction.

“The sanctions available included expulsion from participation in the game and termination or

suspension of membership of the SFA. The Disciplinary Tribunal rejected these as too severe and this tribunal agrees with that conclusion.

“Although this tribunal has listened carefully to the representations from Rangers about the practical effects of the additional sanction, it has concluded that this sanction was proportionate to the breach, dissuasive to others and effective in the context of serious misconduct, bringing the game into disrepute.”

Allan McGregor, another prime target for rival clubs seeking to raid Ibrox for top players at bargain basement prices, insists he wants to stay at Rangers.

When asked if he sees himself remaining at Ibrox, McGregor said: “I hope so. Obviously I can’t look into a crystal ball but in my heart I hope so.

“I’ve never really thought about what if it goes beyond the time frame and nothing happens. I’m just trying to stay positive and hope that something gets done sooner rather than later.”

  20. fergus slayed the blues on

Could it be that Green & co had a fair idea that the decision would go against them ,which would explain the bull they came out with in the last couple of days regards 100m investment and war chest for ally .

Green came out when he took PB status and said they were going to live within their means ,no debt etc ,then all the war chest guff comes out .

Could this have been all hot air in the full knowledge that the embargo would rule any team investment out but the bull could get the ragers support onside .

Remember it was not the so called new owner (in waiting )that employed a QC it was TFF .

  21. A Fine Spring Morning in the Chilterns…

    Justice prevails great to see.

Interesting view from D&P, they suggest that sanctions applied were not available to the panel.

Sounds like they are going to go to Court to insist that the proper sanctions are imposed.

This of course is expulsion. Lets hope so.

    Bluff & Bluffer

  22. Good Morning,

Just woke to the news and scared the kids with my jump for joy and shouts of Ya Beauty!

bye bye rangers. bye bye to ‘The People’

Hail! Hail! to the Celtic Family.

  23. Will the Blue Knights saddle up one last time? (well the last time since the last time since the last time . . . )

  24. Chairbhoy – there is an excellent post somewhere last night (probably between 11-12) that the Panel can basically set whatever sanctions it deems fit and is not restricted to the ones listed in the rules. It is 100% watertight.

  25. They still dont get the fact they should have been thrown out. Hope they do prove a transfer ban is not a valid punishment as that leaves the SFA only one option.

    Stupid huns…

Rangers have vowed to fight on

    despite having their appeal

    against a 12 month transfer

    embargo upheld by a panel

    chaired by Lord Carloway.

The findings of the SFA appeal

    acknowledged that more severe

action, such as expulsion from the

SFA, would have been justified but

    leniency was applied on the

    original judgement.

Rangers were in the dock for a

    number of breaches of rules

    including the non-payment of

    Income Tax and National

    Insurance during the current

season as well as the failings of

directors to act or report on those

    issues.

    Reacting to tonight’s news Paul

Clark of Duff and Phelps said: “The

    decision by the appellate tribunal

to uphold the sanction, namely the

    suspension of registration of

players for one year, is not

competent in the view of the club

    and its legal advisers.

“Such a sanction was not available

to the tribunal and should not have

been imposed and it is the

intention of the club to challenge

    the determination.

    “The club will consider seeking

    review of this most

    disappointing decision and it is

a matter of regret that the

    certainty and finality Rangers

sought on this matter has not

    been achieved.

    “Everyone at Rangers is bitterly

    disappointed and dismayed at this

    outcome.”

    Rangers preferred bidder Charles

Green said: “Our group went into

the purchase of the club with this

sanction in place but we hoped the

    decision would at least be

    commuted.

“We fully support the club as it

    considers an appeal against this

    latest decision.”

    Ibrox favourite Sandy Jardine

    added: “Rangers supporters will be

    shocked and bitterly disappointed

by this decision and will find it

hard to take that the club has

been so heavily punished for the

    actions of individuals.”
