Supreme Court gets to grips with Rangers Tax Case

I long ago promised to take nothing for granted regarding the Rangers Tax Case, as it confounded my predictions from the off, but with the matter underway today with its final arbiter, The Supreme Court, I’m prepared to go as far as to say: so far, so good.

There is a long way to go – so no one should be out celebrating a draw. The matter will not be settled by the performance of a QC on his feet, rather the finer points of law. Today has been interesting, so far, but we will hopefully be well into our next Champions League group stage games before we hear the outcome.

    Hard to tell as Man city have been doing all the chasing.

     

    Monaco’s movement is very good.

     

    Also maybe Pep and City are not as good as the sky hype suggests.

     

    Watching in USA on Fox and the usual bull spouted by the EPL obsessed panel.

     

    They are huge purveyors of the EPL superiority complex despite them being also rans in Europe the last 5 years.

    So he can’t see the game at this point.The mssm are drafting in Wullie Colum to teach him to view it from behind his back as the thatched construction of his wig is proving difficult to remove from in front of his eyes.

  8. Good to see our new head of recruitment in. He obviously has a history with Brendan reading the club statement. Hopefully he will be working 100% to Brendams requirement with only budgetary input from CEO. Anything else is unnaceptable.

    The date from which LNS looked into ebts issued by RFC was 23 Nov 2000 not 2002.

     

     

    This date was used because it was the oldest side letter held in RFC files and Flo was the recipient. That is taken from a HMCL document providing background.

     

     

    Now Flo was paid under the DOS ebt scheme in 2000/2001 until he was transferred to Sunderland in 2002.

     

     

    Under the original terms his contract ran into 2002 but he still wanted paid under it after moving to Sunderland.

     

     

    By this time RFC had moved from the DOS ebts to the loan ones and Flo was paid the balance of his contract under the scheme now under SC review.

     

     

    The earliest side letter was in fact part of the contract with De Boer dated 30 August 2000 and whilst De Boer did not transfer under the initial contract period he too switched from being paid via the irregular DOS scheme to the loan scheme in season 2002/03.

     

     

    In effect both De Boer and Flo owed HMRC £2.8m for tax due in 2001/02 but also owe further tax under the loan scheme.

     

     

    So LNS was misled because the De Boer letter was not provided but even more so by the omission of HMRC letters in 2011 which clearly set out the irregular status of the DOS ebts but RFC’S fraudulent or negligent behaviour in concealing the existence of said side letters from HMRC in 2005.

     

     

    In short Duff and Phelps witheld requested documentation containing information that would have made it impossible for LNS to rule as he did.

     

     

    It is possible following TJN enquiries of the SFA that the SFA had a copy of one of those letters in 2012 when HMCL were asking about to be given anything relating to ebts since 1999.

     

     

    There are more than titles at stake if HMRC win. Heads must roll.

    Adi … Deans (mum’s side of the family) …. but I will ask mum tonight if she knows any Coyles …. I am sure she will know them … whenever I used to go back, I was always stunned at how it seemed everyone in Paisley knew everyone else … my sense is that is changing now … but that sense of community was one of the things I liked when we went back to Paisley ….. it was so different from Toronto..

    Still, today’s proceedings QC Gosh stated 1999 as being the date of their enquiry, submission and arguements. I can only conclude they have documentary evidence back to 99 rather than end of 2000.

    Adi …my gran and her friends spent many, many happy afternoons at the club …. I have many fond memories of going with them and having a pack of crisps and an irn bru ….

     

     

    your father in law was fortunate … not many of us get to be part of creating something that brings as much joy to people as that place for my gran and her friends ….
