Irony behind robust SFA rules

1103

The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:

“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.

“Such a sanction was not available to the tribunal”.

The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.

The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments.  Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.

You don’t need to look too hard for the irony.

  1. Exactly how much have the Duffers extracted from this fiasco?

Do the orcs realise how much the Duffers are creaming off from their beloved criminal organisation?

    Strange administration.

No willingness to pay creditors,no remorse.

Oceans of cash swilling about for massive legal fees.

Talk of millions for Moisty to splurge.

Orcs given free rein to threaten ultra-violence on a grand scale.

What will it take for the authorities to step in and put an end to this rubbish, once and for all.

Then the rest of us can get back to enjoying FOOTBALL.

I wholeheartedly agree, it is the measure of the man that he is posting less on CQN (from what I can see) now that the hard work has been done.

He has been a true number 7 in Celtic cyberspace.

FF is truly hilarious this morning:

“Lord Carloway, Chair Of The SFA Appeal Panel, has an interesting history

He was the Judge who ruled that a satirical football song mocking Shellik supporters, which many believe to be simple banter, was entered into Scottish legal history as ” anti-Irish racism “. Its astounding how the SFA manage to find these individuals.”

    ———————–

“its a disgrace, this would never happen down in england.

    time for foreign judges imho

the taigs have took over all that was good

    i hate scottish fitba now”

They sponsor the SFA somehow and are, quite rightly, being boycotted by Hundom.

They know Rangers fans don’t care enough about the club that has always given them entitlements. Limit it, Capitalise it and kid on about a supply and demand and they are likely to get more money. So much for the 200 thousand strong billy boy army. Most of them are just leeches and they have proven it time and time again.

McGregor, no chance, I don’t like his attitude and he is not that great anyway, Fraser is already a lot better than him IMO. If Neil signed him, I would not be pleased but would trust the man as he has the inside track on Scottish Football players more than anyone else.

the fine imposed on craig whyte at the same time ranjurs got their fine and ban, he said he wouldn’t pay it. From memory his fine had to be paid imminently, when that fine reaches the deadline and if not paid, who then pays it? and what action can be taken against whyte?

I have heard from an excellent source, a source extremely skilled in hyperbole, and creative chimera that the one formerly known as the Holy Goalie will be returning to Paradise in the very near future.

    You heard it hearsay first

  10. pedrocaravanachio6,

I’m sure the stipulation was that if he didn’t pay interest would be added. The fine was imposed on Whyte personally so only he is liable. I would assume that the SFA can sue if he doesn’t come up with the cash.

  11. Gordon_J backing Neil Lennon the below has not been reported up here.

Kittoch. I wouldnt be surprised to see the return of the holy goalie on a bosman. However,I would be a little concerned as players returning to a club for a second time rarely works out. H.H.

Charlie Mulgrew just won all the player of the year awards going having come back to Celtic.

Plenty of times it doesn’t seem to work out, but there’s surely no hard-and-fast rule.

  14. Joe Filippis

I would agree, never go back, …………unless you loved the club and they loved you and you had let yourself go a little and had left the club on a bit of a disappointing note, and were hell bent on rewriting that and making amends and retiring a proper hero.

If Rangers apply for entry to the SFL3 could we possibly convince celebrity Celt and celebrity Spartan, King Leonidas himself, Gerrard Butler, to speak out on behalf of Edinburgh Spartans rival bid?

A tornado made of jobbies with bits of broken glass in them is about to bury Rangers FC forever.

    Now that’s ironical. (thumbsup)

Sorry, old thing, but where is the irony here? It could only be ironic if Rangers had, at some point in their shady past, tried to bury a tornado of the type you describe. I’m not ruling that out, but it seems unlikely to me, given what Bill Struth might have had to say about it and all.

  20. Kittoch,

If true it means we are losing a Brilliant young keeper. I really thought Fraser would stay for the CL. I really like Fraser because of his hard working attitude, Goalies don’t really have to work hard?

It was so obvious Fraser was working hard on all aspects of his game.

No offence Kittoch but I hope you’re wrong.

Artur was very lackadaisical for the last couple of seasons of his time at Celtic (I don’t know the personal issues he was having at the time) but there is the possibility he got bored with Scottish football.

I got bored with Gordon’s (always will be a legend) style of football, and if there was ever a manager to get a fully motivated Artur, it is Neil.

Fraser will be a big loss but Artur would be a big gain, especially if it is a free move.

    Firstly,

P67, Your previous article is well timed. I agree that it is time to move on from the past’s injustices re. SFA and look forward to a new era with trust…(plus taking the moral high ground!)

  33. Hi Paul,

”The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance”

I earnestly believe that the first SFA panel were being lenient and even accommodating to RFCia’s circumstances.

The findings of Lord Nimmo-Smith’s findings were damning and once the uncontentious fact that R@ngers were responsible (…the principles laid down in Tesco v Nattrass regarding corporate responsibility and the “controlling mind” test applied here. – PMcConville) the scope for punitive sanctions was considerable.

However as R@ngers are in administration, out of Europe, had no funds and owed “Football” money their chances of completing any significant transfers in the summer are pretty minute. So in actual fact they have a January window embargo, when in all likelihood they will still be encumbered. In practical terms under the circumstances a paltry punishment.

I’m still of a mind that a sincere mea culpa and plea from RFCia for a suspension or reduction in duration due to exceptional circumstances may have been fruitful, before their reaction fuelled by belligerent entitlement put paid to that.

Some great posts recently BTW. Don’t know how you keep it up, but pls keep it up.
