Irony behind robust SFA rules

1103

The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:

“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.

“Such a sanction was not available to the tribunal”.

The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.

The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments.  Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.

You don’t need to look too hard for the irony.

  3. PAUL Jewell has not given up hope of signing Daryl Murphy just yet.

The Ipswich Town boss is keen to sign the versatile winger/forward permanently following his season-long loan spell from Celtic, while the Scottish champions are happy to let him go after he played no part in their championship winning campaign.

Jewell conceded recently that the Irishman may be out of Town’s price range, however, the EADT understands that all parties are still trying to thrash out a deal.

We understand that Ipswich have been quoted a £300,000 transfer fee, while the former Sunderland man – who still has another year left on his current deal – would also have to accept a significant pay cut to return to Portman Road.

Waterford-born Murphy fulfilled a ‘boyhood dream’ by joining the Hoops in the summer of 2010, however, he ended up making just nine starts in his debut season.

And with the prolific Gary Hooper, target man Anthony Stokes, promising teenager James Forrest and converted left-winger Georgios Samaras all ahead of him in the pecking order, Bhoys boss Neil Lennon will be keen to offload the nine-cap Republic of Ireland international from the wage bill.

Murphy started all but one of the Blues’ final 31 games of the season just gone, mainly playing on the left wing but also providing a different type of threat up front when Town switched tactics. He scored four goals and provided three assists.

Jewell said recently that he wants ‘big, strong and athletic’ players in his team next season. And it was Murphy’s physical presence which saw him given the nod over direct-running Josh Carson for much of the campaign just gone.

Religious discrimination never held me back either after I left Scotland – but it certainly did when I was applying for jobs while I lived there.

It’s heartening to know you have not been held back by petty discrimination, but that’s hardly a barometer of employment practices in Scotland.

As an example I would confidently state that ‘left-footers’ employed in all sections of the Scottish media, from the shop floor to the broadcasters are a rare species.

  15. RANGERS fans’ chief Andy Kerr today urged the club to fight the legalities of the SFA’s transfer embargo to the ends of the earth.

And in a stark warning, Kerr also insisted that the Ibrox support will mobilise themselves to ensure the ramifications of the ban will be felt by ALL SPL clubs.

Kerr said: “There is widespread anger among the Rangers fans, as you can well imagine. We will take a stand now.”

Last night’s decision by a three-man appeal body to uphold the original punishment of a 12-month transfer embargo on players over the age of 18 has been met by a furious response from the Rangers support and Kerr has warned that they will not take the decision lying down.

Rangers’ administrators were today weighing up their options but look certain to take legal action against the SFA, possibly in civil courts or the Court or Arbitration for Sport (CAS) in Switzerland.

Several first-team stars have cut-price get-out clauses in their contracts after agreeing to wage cuts and, should they activate them and leave, Gers would be unable to sign replacements. Already, Everton are eyeing a swoop for Steven Naismith, who has a £2million trigger release.

The Rangers Supporters’ Assembly will now:

*Lobby the club to withdraw from the Scottish Cup next season.

*Plan to boycott all away games.

    *Put pressure on sponsors.

*Call for Rangers players to withdraw from the Scotland squad to face the USA in Florida later this month.

Kerr added: “We feel that while our circumstances are unique, they are not exceptional, yet the SFA seem to be focused on making some kind of an example here.

“There have been other clubs this season who have not been able to pay the wages of their players, yet there has been very little in the way of punishments handed out for that. Ultimately, we have to do what we think is the best course of action now.

“We met when the SFA first announced the transfer embargo and had preliminary discussions about what to do. But at the time we felt we were jumping into it too quickly, and we wanted to wait and see whether or not common sense would surface at an appeal.

“That hasn’t been the case and the club need to take this fight all the way. They have to challenge this tooth and nail.

“The body of opinion is definitely behind taking the players out of the national team, although personally I would have to say that I am cautious about pushing for such a thing because it isn’t particularly fair that the international career of a player is hampered because of this situation.

“But at the same time, if Allan McGregor or Lee Wallace or Steven Whittaker get injured when they are playing for Scotland, how do we replace them?”

Kerr also believes that the whole of Scottish football will be punished because of the embargo.

He added: “When Rangers signed Steven Naismith from Kilmarnock, the sale went a long way to ensuring that the Rugby Park club did not go into administration.

“There are lots of players in the SPL that I am sure Rangers will have been looking at, and the bottom line is that buying these guys from other Scottish clubs benefits the game.

“If you take that out for a year then I am sure there will be one or two clubs who will feel it.

“The Rangers support need to do everything within their power to make a stand now.

“We are bitterly disappointed at the decision to uphold the embargo … but it is not finished yet.”

  21. I am not surprised to see the threats from rangers fans individually and Andy Kerr to intimidate, boycott and riot on a grand scale. With plenty of practise from Wolverhampton to Birmingham , Newcastle to Barcelona not to mention the use of Manchester as a toilet , it is within their capabilities.

It really shows that society and Scottish football is better off without them. I have been. I have occasionally came across the hordes while travelling on business through the years. Animals behave better.

So Mr Kerr take up this war , watch the knuckle draggers follow you as did Ally on the original SFA independent committee. It will be a boomerang as Scotland is fed up of the antics of the watp brigade.

Far from being essential to Scottish football, they corrupted it; they shamed it; they defrauded it. Then they have the gall to blame it all on a big boy who ran away.

  27. Going back to 1965, how ****ing desperate!

Asked if the club would now go to court

to challenge the SFA’s ruling, the former

    Sheffield United chief executive

responded: “We need to consider our

position and speak to the SPL and the

    SFA.”

It is unclear whether the club is able to

take its case to the Court of Arbitration

for Sport in Switzerland, which is

dependent upon the SFA having an

arbitration agreement with the court to

    deal with matters relating to

    punishment of its members.

The club could also request a judicial

review at the Court of Session in

Edinburgh, which is the route St

Johnstone took in 1965 when they

contested a £25 fine they received for a

    testimonial match from the SFA.

    So let us rephrase that.

We want to weaken our opponents by taking their players from them.

We will not however be able to pay them the agreed transfer fee.
