Irony behind robust SFA rules

The statement released by Duff and Phelps last night revealed the substance to the lobbying that had taken place since the original punishment handed out by the SFA judicial panel:

“The decision by the appellate tribunal to uphold the sanction, namely the suspension of registration of players for one year, is not competent in the view of the club and its legal advisers.

“Such a sanction was not available to the tribunal”.

The suspension of player registrations was not one of the suggested punishments on the menu for the judicial panel but the rules allowed them to vary from guidance and choose whatever punishment they believed appropriate.

The appeal correctly found that the judicial panel were not were not subject to an exhaustive list of possible punishments.  Duff and Phelps main hope was that the SFA rules were unclear and poorly constructed, as they were before an overhaul last year.

You don’t need to look too hard for the irony.

  1. I suspect Green will offer the reported 8.5m for physical assets (Park, MP and Albion) in either a CV or Newco, either way the creditors will get a pence in the pound deal but they might get a bit more from the players firesale as IMO they are not included in the Green bid.

     

     

    D&P shoul dbe able t osell them off for maybe another 10M to add to teh 8.5m so more for the creditors if liquidated.

     

     

    IMO creditirs will go for liquidation as the better option

    Just had a few days with son, his wife and two grandchildren.

     

     

    Kids ( aged 5 & 2.5) were full on for 5 days and Mrs RWE and I were loving it.

     

    Son and wife got to put feet up for a few days.

     

     

    On Sunday, grandson, son and I all danced round the room as Gary Hooper scored for fun.

    Rangers fans’ president caught drink-driving after match

    A RANGERS supporters leader was caught drink-driving on the way home from the club’s first game since plunging into administration.

     

     

    Andy Kerr, president of the Rangers Supporters Assembly, was stopped on the M74 after attending his team’s 1-0 defeat to Kilmarnock on Saturday.

     

     

    He was breathalysed by police and found to be more than three times the legal limit.

     

     

    Kerr, 54, spent two nights in police custody before admitting the offence at Lanark Sheriff Court on Monday. He had been travelling back to his home in Harrogate, North Yorkshire, when he was stopped on the motorway near Coalburn in Lanarkshire.

     

     

    Kerr, a first offender, was banned from driving for two years and fined £670.

    If the other 10 clubs are now facing not only a boycott from Celtic fans if they vote for a newclub,but also a boycott from rangers fans unhappy with the decision of the SFA,then surely the debate is now over.There can be no commercial benefit accrued if both celtic and rangers fans don’t turn up.

     

    I really really hope they continue on their current beligerent path

    My guess is the reason why RFFF paid for the appeal’s brief was that D&P’s Counsel advised their chances of success were minimal.

     

     

    Civil Court action would put them down the Sion path – ruination.

     

     

    I’m not sure of the powers of CAS but the potential outcome must look like this.

    Uphold the decision – Probable

     

     

    Assert that the SFA impose the prescribed Sanctions (i.e. Expulsion, Suspension) – **Possible

     

     

    Unless RFFF recklessly force their hand and pony up again I can’t see them going down this route.

    Surely Sir David had the chance to put his case to the original panel, if not then he certainly could at the appellation tribunal, I believe the SEETHING SDM did not take this opportunity to clear his name and is still in contemplation in terms of legal action.]
