Questions for SFA as they inadvertently spotlight Nimmo Smith evidence

I know you don’t need to rehearse the Resolution 12 debate as you’ll know it instinctively now, but, as always, we are indebted to eyes outside of Scotland calling for insight and governance in the Scottish game on an issue only tangentially related.

Yesterday, The Offshore Game, ran a report that the SFA may have misled the Lord Nimmo Smith Commission inquiry into Rangers failure to register players on an industrial scale during their EBT years.

While the SFA were swatting away questions into how Rangers were cleared to participate in Uefa competitions in 2011, less than a year before disappearing into insolvency, chief operating officer, Andrew McKinlay inadvertently turned the spotlight on the reliability of evidence placed before Lord Nimmo Smith.

Questions around the awarding of Rangers Uefa licence in 2011 were asked in the dark as no one outside the club, SFA and Uefa knew what information had been submitted, and the SFA didn’t know what the club submitted to Uefa.

There was a belief that the club may have not disclosed a letter concerning the Wee Tax Case from HMRC to the SFA in 2011. Mr McKinlay wrote to the requisitioners saying that he “did not accept that” this information was not brought to the SFA’s attention in 2011 – two years before Nimmo Smith sat.

This assertion tidied up the Res 12 issue at Hampden, but as The Offshore Game makes clear, why on earth did the SFA’s evidence to Lord Nimmo Smith on the Wee Tax Case not reflect the correspondence they had on file? In short, it was accepted by all that schemes scrutinised by the Wee Tax Case were unlawful.

Nimmo Smith didn’t hear this, in fact, he heard was that Rangers tax schemes were legal, and concluded, therefore, as any other club could have used them, no sporting advantage was accrued.

The Offshore Game call for scrutiny of the SFA over this by the parliamentary Culture, Media and Sport select committee. This call will be magnified should the Supreme Court uphold HMRC’s position on the Big Tax Case.

    I should have noted the monikers of the bhoys who this morning , were kind enough to respond to two of my posts regarding Nimmo and ” Racism” ?

     

    Nimmo-

     

    I accept that using an example of me robbing a bank was perhaps the wrong example to use however , as their EBTs were deemed to be apparently ” legal” at that time ? Robbing abank is apparently not ? Pity.

     

    Is it true to state that due to the possibility of ” new evidence” coming to light, such as oldco and the SFA, NOT providing ALL available evidence to Nimmos inquiry, that somehow Nimmos inquiry could be deemed to be unlawful, as that inquiry failed to consider ALL evidence that was in existence, but NOT considered at that time ?

     

    Racism-

     

    Obviously the word/ description Fenian is not racist/ offensive on its own, but allow me to give you a FACTUAL example of how a certain word COMBINED with the word ” barsteward” ? actually leads to someone being arrested by the cops.

     

    At CP during a game against the Hun, a young friend if ours was huckled by the cop Celtic end and taken to the station and charged . His crime ? He shouted that the ref was an ” Orange Barsteward”.

     

    I never saw that young fella again but his cousin who I knew and who was present that Saturday afternoon went to London Road Police station after the match, and on asking about his young cousin, another cop asked him, ” what did he get jailed for” ?

     

    My mate quickly replied, ” Cos he’s a Celtic fan” !

     

    The Polis was not amused, and my mates young cousin spent the weekend in the cells.

     

    Now, if I shout to someone in the street, ” Your Orange”, how can that be offensive etc, especially if that other buy is ” orange” ?

     

    However,if I shout ” your an orange barsteward”, that combination of orange and barsteward can be deemed as offensive and possibly racist ?

     

    I don’t know any more, I used to be smarter than this…old age.

    McCoist is at odds with general belief that it is second or bust for Warburton at Ibrox. “I think some people might think that.   4. This so called offence happened on the terracing in the Celtic end during the mid 1970s !

     

    Myself and a few others told the Cops when the arrested this friend if ours ( maybe about 17 ?), how can you arrest him for that , why don’t you arrest everyone on that pitch ?

     

    Or words to that effect, but hopefully you get my drift ?

    LNS – Was allowed to act the dafty, kiddin-on that he was duped etc coz, he and the establishment knew that the Cellic PLC would look the other way.

     

    Even the Aberdeen fans who came to CP sortly after the outcome, waved a banner at the Cellic fans that day that read….”Celtic FC – Your Silence Is Deafening !”

     

    Do you think that – for example, if our club had a rebellious leader who would rattle the cages, a NFL of the boardroom, that the huns would have gotten away with what they have ?

     

    Ye see, the Cellic supporters are on the ‘outside’ of they’re club and, no matter how many of them turn up for games – they have no clout except for when they leave empty 30,000 seats and, the prospect of those seats not being renewed….then the PLC will ACT by, bringing in Brendan!!!

     

    Now, can ye imagine the re-action of the PLC if – 30,000 Cellic supporters had issued a threat to the PLC that, seats would not be renewed until….LNS was ‘properly’ investigated ???

     

    Then, and only then,….will the PLC take on the establishment….imho.

    Ah got ejected from the ground when ah was 13 at Cellic Park in 1977.

     

    My mates and I were on the back of the Jungle wall hanging onto a big thick green metal pipe that ran all the length of the Jungle wall and we were singing about Billy Reid and got to the bit,…”…although he was dead, he was kicked in the head and was dragged by the hair all around…” we shouted Orange b’s at that bit as a wee add-on that we used to sing on the train….cops grabbed 4 of us and flung us ootside the park. It was freezing cauld midweek vs the huns and ah think w won 1-0 ?

     

    Nae charges or whatever…just put ootside.

    As regards keeping the lid on the SPL lawyers Harper Macleod were written to from SFM in 2014 with a batch of documents revealing the true nature of the DOS ebts and the side letters to De Boer and Flo.

     

     

    That batch included a HMRC letter of 23 Feb 2011 which contained much of the same content as is in the 20th May 2011 that the SFA appear to admit (and should have had) is in their possession from May 2011.

     

     

    That letter to Harper Macleod was “legalled” in the sense that the draft was seen by a lawyer who agreed with the Conclusions that the failure to supply that information rendered the LNS Decision untenable.

     

     

    Harper Macleod’s response made little sense and further correspondence copied to the SPL Board was eventually passed to the SFA!

     

     

    Neither the SFA or the SPL/SPFL acted on the information received.

     

     

    Same 3 monkey routine after the original TJN report and unless supporters demand that LNS be laid aside regardless of the final BTC decision, we are in effect say it’s ok to lie to us, in order to cover up the enormity of the damage inflicted on our game. As long as our teams are out there every Saturday and enough turn up to watch we accept we are not worth the truth or accept the illusion it is a sport.

     

     

    The latest TJN report could end up the same way but the linkage to Res12 is absolutely clear and that point will be made to Celtic who indicated in November last they would act on LNS once the final decision has been made.

     

     

    James Forrest uses the Ratner analogy and it’s not far off. The charade that passes as governance has to end and LNS is an issue that affects all SPFL clubs since it was their Commission that was subverted.

     

     

    Assuming of course Regan and Doncaster were not in cahoots long before Hugh Adams forced action in March 2012 in his interview with Alex Thomson.

  22. The biggest threat to Celtic park for safety are the polis, and that’s after a game, traffic or PC plod, not a one will you find within the footprint of Celtic park after the final whistle, they’r awe halfway home by them, shower a iceholes the lot of them.

    I remember talk of a dossier but what I was told and I think it became public when George Peat spoke about it is Celtic had a DVD of referee decisions that were questionable.

     

     

    The story goes that Ton Mowbray was invited to sit with Hugh Dallas and examine each.

     

     

    Dallas then gave his explanation and if Tony M was sceptical the question was “are you not accepting what I say or are you questioning the referre’s integrity?”

     

     

    There are 2 points from this. Celtic were not happy with the SFA and without proof they were screwed.

     

     

    They were also unhappy with the way the review panel was run and were very happy to take a resolution from the floor on that subject and more from an Open Meeting in St Marys around the same time to the SFA and that process was changed.

     

     

    Things aren’t always as we see them.
