Questions for SFA as they inadvertently spotlight Nimmo Smith evidence

I know you don’t need to rehearse the Resolution 12 debate as you’ll know it instinctively now, but, as always, we are indebted to eyes outside of Scotland calling for insight and governance in the Scottish game on an issue only tangentially related.

Yesterday, The Offshore Game, ran a report that the SFA may have misled the Lord Nimmo Smith Commission inquiry into Rangers failure to register players on an industrial scale during their EBT years.

While the SFA were swatting away questions into how Rangers were cleared to participate in Uefa competitions in 2011, less than a year before disappearing into insolvency, chief operating officer, Andrew McKinlay inadvertently turned the spotlight on the reliability of evidence placed before Lord Nimmo Smith.

Questions around the awarding of Rangers Uefa licence in 2011 were asked in the dark as no one outside the club, SFA and Uefa knew what information had been submitted, and the SFA didn’t know what the club submitted to Uefa.

There was a belief that the club may have not disclosed a letter concerning the Wee Tax Case from HMRC to the SFA in 2011. Mr McKinlay wrote to the requisitioners saying that he “did not accept that” this information was not brought to the SFA’s attention in 2011 – two years before Nimmo Smith sat.

This assertion tidied up the Res 12 issue at Hampden, but as The Offshore Game makes clear, why on earth did the SFA’s evidence to Lord Nimmo Smith on the Wee Tax Case not reflect the correspondence they had on file? In short, it was accepted by all that schemes scrutinised by the Wee Tax Case were unlawful.

Nimmo Smith didn’t hear this, in fact, he heard was that Rangers tax schemes were legal, and concluded, therefore, as any other club could have used them, no sporting advantage was accrued.

The Offshore Game call for scrutiny of the SFA over this by the parliamentary Culture, Media and Sport select committee. This call will be magnified should the Supreme Court uphold HMRC’s position on the Big Tax Case.

    The CFCB was set up for exactly this kind of issue that is why they were our body of choice, I think you might be confusing this with the issue that clubs cannot take action against their association through the civil justice system which of course the is now a new presceden set for doing this in Scotland without censure :)

    all the teams who finished second or runners -up in cup comps. deserve the titles.queen of south get a cup and so do falkirk.bit late for them but it counts just the same.and the SFA owe them the money to pay the bonuses that the players were due.the SFA can always get the money from SEVCO by deducting it from tv monies.

  7. Re titles being stripped gained etc.

     

    My close pal, now dead, and I had been season ticket holders since we were bhoys and frankly for all the pain it caused us I would like the titles stripped. Don’t care if they are marked as an asterisk, meaning cancelled, but let them have some pain. Whatever sevco can’t have them or any other history …. going for 1 lol

     

    Appreciate that is the emotional feeling, more likely a forced change in the sfa is what we might get

    No problem if you don’t and prefer to write to PL instead, though with respect, what you will get from PL is PL’s position and not necessarily my own, and the two may very well be capable of different interpretations and come from different states of knowledge depending on what is asked.

    Been thinking of doing a wee review of teams they met in Europe who were later denied a license, I think there will be a couple, oh what fun writing that letter to the boards of clubs who lost out at both ends of the spectrum :)

    I’m no expert on this (hell, I’m no expert on anything), but here is my take/understanding of it.

     

     

    1. Had the information about the DOS Tax liability (wee tax case) been declared as part of the application for a European Licence between March and June 2011 then the SFA would NOT have been able to issue the licence Rangers (IL) for the 2011/2012 season.

     

     

    2.. If it had come to light after the licence was issued that Rangers (IL) had an outstanding tax liability and were ineligible to compete in Europe during 2011/2012 season and UEFA were in a position to apply sanctions, this sanction would have been for the 2012/2013 season.

     

     

    Therefore the fact is that Rangers (IL) should not have been issued the licence in 2011/2012. The SFA have now publicly admitted they had this information prior to issuing the licence, so the issue of their malfeasance is now evident for all to see! (Unless you are a myopic hun zombie of course).

  23. I was in the Blane Valley yesterday afternoon-evening-night with some very fine CQN’rs all with differing opinions about the Board, PLC, etc.

     

    BRTH was good enough to pop in from his very busy schedule for a small libation of the non-alcoholic variety, unlike the rest of us, lol. He gave a very reasoned summary of where we are regarding Res 12 and why.

     

    Now as far as I am concerned we are very lucky to have had the 4 ‘amigos’ do this work on our behalf both shareholders and non-shareholders alike, so how any Celtic fan can call them out and question their integrity or motives is totally beyond me. These guys are doing this in their own time without even considering any form of remuneration. They just want to see justice done and a level playing field being established for ALL the teams in Scotland.

     

    One question for all the Res 12 snipers – what have you done about sporting integrity in our game? Only asking.

  25. Just reading on the beeb site that a former Crewe Alexandra youth player was a victim of assault from the age of 11-15 by one of his coaches who has since been imprisoned.

    The SMSM, Sevco and the SFA should hang their heads in shame especially the latter as the greatest Scottish/UK manager died for them and also helped carry the stricken supporters of the deid team while the rest of us were sitting at hame feeling sorry for them but still tucking intae New Years left overs.
