Two things.
1. As already said this gives HMRC more than enough ammo to pursue unpaid tax from the same club.
2. The ECA are not the authority on football governance.UEFA are and why their view was not sought is puzzling. However questions have gone to UEFA asking if The Rangers will be able to play in Europe if they win the SC ( or lose to title winners) in the next two years.
According to UEFA rules they have not been members of a national association long enough to get the required UEFA licence which kind of kills the notion it is the same club.
The ASA are producing a conclusion that protects their industry as LNS did to protect the SFA using SFA testimony.
This insistence on being the same club when all they have done is use the system to continue tax avoiding will bite both football and The Rangers on the bum if HMRC question the misuse of insolvency law and UEFA, with a wider responsibility to protect their authority, set out why The Rangers like Derry City were unable to participate in Europe for 3 years which is because they have insufficient history as a football club ( as UEFA define one – no club/ company crap) who have had a membership of a national association to comply with UEFA licensing conditions.
If this stands UEFA FFP Article 12 falls, indeed the articles relating to unpaid tax are undermined if insolvency simply becomes an attractive vehicle for tax avoidance so UEFA cannot afford to stay silent. In fact they might be getting pissed off with how their governing principles are being ignored by the SFA.
It will however require the issue to go political with tax payers asking their MPs if what is happening at The Rangers has UK government support and that requires making tax payers aware they are being robbed by inadequate insolvency laws.
This aint over until its over.
