Raith call out SFA plans for Appellate Tribunal

You wonder if Ally McCoist rues the day he called for the public outing of members of the SFA Judicial Panel which imposed a player registration ban on his club.  One judge, one journalist and one football club, Raith Rovers, were soon outed.  Crossing the Fifers was a mistake.

Raith Rovers are now pointing out the same facts we have discussed here for months:

“We are also concerned that there has not as yet been an opportunity for clubs to receive legal advice from the SFL and/or debate the potential consequences on the smooth running of our league in the event that the Courts are asked to annull/strike down any of the corporate transactions that have led to the current position of Sevco Scotland Ltd as owners of certain assets of the Rangers oldco.

“Indeed, the position as regards the potential sanctions to be applied by the Scottish FA via its Appellate Tribunal has also still to be bottomed out.”

In short, Sevco’s ownership of Ibrox may be nullified by the courts and the SFA will be forced to subvert judicial oversight if it wants to guarantee Sevco participate in football next season.

While these concerns were only expressed online, the SFA were able to ignore the issue, but with Raith Rovers asking the questions Mr Regan will have to look SFL clubs in the eye and tell them what he’s going to do with Lord Carloway.

Lurgan 53

Dwyer O’Hagan, or Lurgan 53 as he was known here, passed away on Wednesday after an illness stretching back to last year.  Dwyer enjoyed our triumphs and defeats on the blog for many years and will be sadly missed by us all.  Our condolences to his family and friends.

    No surprise then that Jim Traynor twice in the last 30 minutes tried to deride Turnbull Hutton.

     

    Traynor knows the RR points are valid so he does what he does on air, interrupts and talks over anyone in order bury their point rather than address it.

     

    I’m backing Turnbull Hutton to win the day because clarity on the true nature of Sevco has to be established, whatever Sevco provide the SFA to allow them to grant Sevco a membership has to be supplied to all SFL clubs, even Traynor made this point, obviously not realising he was supporting Hutton.

    He cannot imagine life without them and the lazy stories he’s printed for years in his rag drying up. My problem is that the BBC give him a platform to pursue his commercial interests. His attack on Turnbull Hutton was a disgrace, using the word ‘bilge’ to describe his contributions shows how low he’ll stoop in his attacks on those wanting much needed change in Scottish football.

  8. According to the BBC, this is what SFL clubs will be asked to vote on come Friday:

     

     

    “that Rangers FC shall play in the Third Division of the Scottish Football League during Season 2012/13 unless the board shall have to its satisfaction negotiated and reached agreement with The Scottish Premier League and The Scottish Football Association on a series of measures which the board shall consider to be in the best interests of the game…

     

     

    “How it is structured, how it is governed and how it is financed, whereupon the board shall be authorised to provide that Rangers FC shall play in the First Division of the Scottish Football League during season 2012/13″.

     

     

    “The document adds: “Details of the series of measures referred to…shall be made available to the members in advance of the meeting and an opportunity for full discussion of those measures will be given prior to the proposals being put to the meeting.”

     

     

    How can any club be expected to support that? Division 3 unless the Board decides otherwise if it feels it is being sufficiently bought off?

     

     

    It seems like a gun is being put to the clubs’ heads. Leave the Board to sort it or vote against and there is no Sevco at all.

     

     

    A risky move – and one that could backfire.

  10. In reply to Bobby Murdoch’s curled up winkle pickers (fascinating handle) I have to say that here in deepest Ayrshire and that cradle of blueness, Auchinleck, there is no evidence of bigotry. Well not much. They tend not to care if you support Celtic or Sevco as long as you’re no frae Cumnnock.

    Raith Rovers as a club deserve much credit for their recent contributions to the crisis caused by the collapse of Rangers. They are not alone of course, but I think it is fair to say the efforts of their office holders, first as part of the Independent Panel, and since in their reaction to the efforts of the SPL and the SFA to impose decisions, firstly on the SPL clubs themselves, and failing that on the SFL as a whole, have been both brave and bold. It is not the SFL that has a position to defend, it is the SFA. In attempting to force the SFL to accept Sevco, against the SFL’ own rules the SFA has shown it is no longer a fit and proper organisation to run, or to regulate football in Scotland. As of now, that looks more and more that that should be role of the SFL. The SFA, for its part needs start reading its own articles of Association and its’ own rules and regulations.

  13. First I’d like to offer my condolences to all friends, family and aquantences of our recently passed Lurgan 53.

     

     

    As to the state of Scottish football, ther’s many an incident over the last while which has left me with a very unpleasant taste in my mouth, not least of these is the actions of the Kilmarnock FC, we’ve known for years and years that this clubs sympathies lay with there cousins in Glasgow’s west side, but their choice to abstain from voting whether or not to pass share over to Sevco is despicable and I hope that while the Celtic supporters association take some measure to thank the supporters of the 9 other clubs I also hope they take some action to show that we took notice of their obvious support of the ex football club from Glasgows west end.

     

    Michael Johnston in my opinion is a rat, he knew the way the vote was going to go, he knew that the suppoters of his club agreed with the rest of Scotland and yet instead of showing that cheating and lying will not be tolerated he did not even have the cajones to stand up and be counted as a supporter of cheating, no he abstained.

The main purpose of a liquidation where the company is insolvent is to collect in the company’s assets, determine the outstanding claims against the company, and satisfy those claims in the manner and order prescribed by law. Rangers FC circumvented the rule of law by transferring their assets into a new debt free club to avoid having to pay the creditors the bills and taxes they owe. This is a criminal offence. Sevco should not have been allowed to purchase Ibrox and Murray park, because these assets rightly belonged to the creditors, and as tax payers, we have a right to claim these assets back as they were bought illegally.

     

     

    Furthermore, many companies in debt (such as Rangers FC) decide it’s more beneficial to start again by creating a new company, often referred to as a ‘newco’ company. In business terms this will mean liquidating a company as the only option and then resuming under a different name with the same customers, clients and suppliers. In some circumstances it may appear ideal for the directors, however if they trade under a name which is the same or substantially the same as the company in liquidation without approval from the Court they will be committing an offence under S316 of the Insolvency Act 1986. Persons participating in the management of the ‘newco’ company may also be held personally liable for the debts of the company under s317 of the Insolvency Act unless the Court approval has been granted. So far no court approval has been made. This means our administrators at the top of the SFA/SFL/SPL have been aiding and abetting illegal activity by treating Sevco as if it were the old Rangers FC company and if Sevco wish to insist they are really the old Rangers in disguise, they are liable for all the old Rangers debts.

     

     

    On the Rangers FC official website, Sevco appears to be claiming they are now Rangers as if nothing had happened. Ally McCoist has stated they have been punished enough as they have been banned from European competition for three years. Of course this is a false claim because any new company must submit 3 years audited accounts before being allowed to compete in European competition, and since Sevco are a new club they are subject to the rules of the game (at least in Europe) just like any other new team. In Scotland however, the rules are being ignored, changed and manipulated in order to accommodate the fraud of the new debt free Sevco. Using fear and bribery tactics, our top administrators wish to bend the rules so that a new debt free company with no audited accounts can play in the higher levels of Scottish Football putting sporting integrity aside in favour of commercial interest. Contrary to their “Armageddon” fear tactic, if they are allowed to succeed, they put the whole of Scottish football in grave danger and disrepute, open to punishment from UEFA for overturning the laws of the game to suit commercial interest. All Scottish football teams could be banned from European competition and our national team banned from participation in the World Cup Qualifiers. Even most of the Ranger’s fans would prefer to start afresh in division 3. If our administrators get their way and the corruption is allowed to go ahead as they plan, tens of thousands of fans will turn their back on Scottish football, scunnered by the obvious corruption being favoured over sporting integrity.

     

     

    Should a debt free Sevco be allowed to pretend they are Rangers and play in the first division for one season before getting promoted back into the SPL, they will have been allowed to shed the burden of over 100 million pounds of debt, and will therefore have an obvious advantage over all other teams who have paid their bills and taxes and competed within the laws of the game.

     

     

    Our administrators are supposedly in these responsible positions in order to uphold the laws of the game, not to overturn the rule of law for the sake of one club and commercial interest.

    I think it is great that other Scottish teams are standing up for integrity in our game. Forget all the baloney from the press and maladministrators of the game. Rangers have ruined the game since Souness first appeared.

     

     

    I think we are witnessing the rebirth of our game. We should stand shoulder to shoulder with those decent people speaking out against the crap Reagan and co are peddling.

     

     

    Football in Scotland should be no more about just the sfa and rangers.

     

     

    When the huns are sorted out the focus must turn to the sfa and spl. They are incompetent, conflicted and stupid.

    As ever I hope your analysis is correct but the level of bias on the Sportsound programme tells me the pressure on SFL clubs this week will be too much for them to bear.

     

     

    My hope is that SFL fans take the same stance as SPL fans and encourage their clubs to reject the notion of SPL1.

     

     

    In a just world this nonsense would have been squashed by UEFA ages ago but it seems clear they are not interested.

     

     

    Time will tell.

    Just back from a trip to CP for Ajax tickets and then a walk into the town centre- and I felt like calling out rentokil. Went into KFC at CP to be greeted by a 30 year old ?woman with a red hand rag draped around her shoulders, I then walked through the throng at Glasgow cross hearing drunken bigots belt out FTP in front of disinterested polis- it was like the wrecking of the CP toilets all over again. I blame their schools
