Referring to a team no longer with us

753

Let’s be clear, you cannot punish a player on the basis that he has made a comment which is only offensive, offence is subjective, highly so in Scottish football, where thousands await the opportunity.

Nor can you punish a player for a derogatory remark which may offend, especially if the remark does not call into question the probity of the subject.  “Hearts are rotten, we beat them easily twice this season”, is a derogatory remark and will offend some Hearts fans, but it also falls into the category of being a fair opinion.

And without pointing out the obvious, you cannot offend the dead.  John Guidetti and the club are right to contest this ridiculous charge, which by context, clearly refers to a team no longer with us.

I was absolutely astonished to read that newco (and former oldco) director, Paul Murray, explained Dave King’s absence from newco’s recent share as he is waiting until the SFA “have completed their review of Dave’s status before he can fully participate in the future of the Club”.

The SFA have no issue whatsoever in Dave King investing heavily in newco, or in owning all shares.  Indeed, King is already the largest shareholder, which has attracted no attention from the football authorities.

The prospect of King sloping off if the SFA judge him not Fit and Proper (which I think they will), is a fabulous twist in the work of this legendary non-executive director of a dead club.  He sat on the oldco board which paid EBTs for so many years, he stayed while they made no provision for the HMRC tax case, plunging into the transfer market instead.  Now he awaits the whim of the SFA before deciding to invest, having led newco away from their primary source of funding.

What a star.

I’m not hiding behind anything Tom. What I’m saying is that I don’t think any supporters’ organisation will act without the support of their membership.

You know I disagree with your premise but I also know you feel passionately about it.

If anyone wants their organisation to act then they should get off their arse and force them to do something.

  5. Lionsroar 67 Being barred on Radio Clyde and The Daily Record .I Am going to guess that you are Terry O Neill.

  6. If I don’t vote Labour at the upcoming election I will abstain. No way will I vote for that nationalist shower who seem to enjoy a generous press on this site. Murphy by comparison is marginally less popular than the Yorkshire Ripper. Still angry at Ecky-thump’s pre quazi referendum prevarication on core economic questions. Why one of the richest countries in the world ( Sturgeon’s civil service brief) even required a monetary union ( the members simply insure each other) was beyond me.

Although now a nominal RC I nonetheless wonder how representative of the RC community the SNP really are in 2015. On a pro-rata basis at least 12 as a bare minimum out of their 59 election candidates should be RC , if only in name. Anything less then perhaps the current love-in is a trifle premature.

Good news to end ; thought I had a tenner in my pokeit but wee Ecky assures me its 13 times that !

  9. I had to read that joke of a statement from the RST twice because I couldn’t believe the breathtaking arrogance contained in it. My whole life I have had these clowns insult me and if any response was given was told”what’s wrong it is just a bit of banter” but they don’t see that when they are on the receiving end. My God they really don’t do irony.

We need to face up to them and take them on about this. I really didn’t know the little babies were so precious.

  11. Four years ago almost to the day…………..

‘Celtic will not call for George Peat’s resignation, despite criticism of the Scottish Football Association president in a judgement from Lord Carloway.

Peat’s attendance at a disciplinary hearing for Celtic manager Neil Lennon was held to be “contrary to principles of fair play” after a club appeal.

Lennon was given a six-game touchline ban for excessive misconduct in the game against Hearts in November.

But Celtic sources say they will not call for Peat to stand down.

There had been suggestions that the Glasgow club would target the president once the appeal findings were published.

Celtic were unhappy that Peat, who was not part of the disciplinary committee, was in the room with the four members of the committee while they were considering what punishment to hand out to Lennon.

It had been argued by the SFA that Peat had no involvement in the decision-making process and was simply there as an observer and, at one stage, the president left the room to take part in the Scottish Cup draw.

“It is quite contrary to British principles of fair play that any person outside the members of the tribunal itself should be present”…….. Lord Carloway

Paul McBride QC, representing Celtic, argued that Peat should not have been there at all as a matter of procedure and natural justice.

Now the full written findings of the appeal have been published, giving the reasons why the original decision was set aside, resulting in Lennon’s ban being reduced from six to four games.

“The problem, which the board considered to be an insurmountable one in terms of the perceived fairness of the committee’s decision, relates to the presence of the president during the private deliberations of its members,” said Lord Carloway.

“It must be stressed that the board has no material upon which to conclude that the president attempted to influence the committee’s decision.

“In this regard, the board does not criticise in any way the president’s good faith. However, the principle of justice being seen to be done is an important one, especially in disciplinary procedures.

“It is quite contrary to British principles of fair play that any person outside the members of the tribunal itself should be present when the members are deliberating.

“Although the president did not have any interest directly adverse to the appellant, it would nevertheless have been preferable if he had not been present at the deliberation stage.

“The board should add that, if it is answered that the president was himself a member of the committee, he would then fall foul of the principle that a member of a tribunal, who has not heard the whole case, should not participate, or be perceived as participating, in the decision-making process.

“For this reason alone, and despite its other findings that the hearing had been an entirely fair and just one, the board considered that it had no alternative but to set aside the committee’s decision.”

Meanwhile, Celtic will continue to fight vigorously the SFA’s decision to make Lennon’s current four-match ban consecutive to his previous suspension, as opposed to concurrent’……………….

    And today, what has changed???

Your last line nailed it. Despite being up against it, we’ve beaten the Establishment club in every way that matters. I wouldn’t call it a war but when they ceased to exist in 2012, I think their was a realisation on BOTH sides, that Rfc 1872 had lost the ultimate contest, and Timmy had prevailed against the odds.

A feeling of shame, embarrassment and rage has permeated through the corridors of power, the hun support and most of the msm. As they dread the prospect of another two massive Poznans, one for the cup and one for the treble (whichever order) it’s all hands to the establishment pump, trying to drag us down in any way.

All so pitiful, so futile and too late.

I’ve never wanted a treble so much (quadruple if Sevco implode) and if it happens I’ll celebrate another Celtic achievement against not just the odds, but the whole rotten corrupt entity that exists to serve one club.
